The Delhi High Court Monday declined to entertain a plea which alleged that a film titled ‘Aankh Micholi’ portrayed people suffering from various disabilities in a derogatory manner in violation of the the Rights of Persons with Disabilities (RPwD) Act. Advocate Jai Anant Dehadrai, appearing for petitioner Nipun Malhotra, argued before a division bench of Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora that his client, who has locomotor disability, is a disability rights activist and is “impugning certain segments of the film” as violative of the RPwD Act.
The film, produced and distributed by Sony Pictures Films India Private Limited and starring Mrunal Thakur, Abhimanyu Dassai and Paresh Rawal, was released November last year.
Arguing that the “entire film is rife with very offensive references,” Dehadrai said, “It is supposed to be a comedy but is an extremely distasteful portrayal of individuals who have permanent disabilities. It has the effect of perpetuating certain negative stereotypes”.
