Taking cognisance of a news report that 17 lost their eyesight after undergoing cataract surgery in a trust-run hospital in Ahmedabad, the Gujarat High Court on Wednesday initiated suo motu proceedings and sought a report from the state government on the incident.
Referring to the news report published in the Ahmedabad Mirror, a bench of Justices AS Supehia and VK Vyas described the incident as “glaring and deplorable”. It issued notices to the secretary of the health department as well as the superintendent of police of Ahmedabad Rural.
The court posted the matter for hearing next on February 7, with a direction to the state authorities to file a preliminary report on the incident.
The bench noted that the 17 patients were operated on between January 1 and 10 at Ramanand Eye Hospital, run by the Shree Seva Niketan Trust in Mandal block of Ahmedabad district, and were now admitted to hospital with “severe postoperative complications, hospital-acquired infections after cataract surgeries”.
“The news article does not refer to any criminal complaint being filed by the state authorities against the erring medical personnel who are responsible for the occurrence or any other staff members. The incident requires a thorough and sincere investigation for fixing the liability of erring persons and also to pay suitable compensation to the victims who have ultimately lost their vision,” the bench said.
“It is also essential to know whether any substandard drug was issued while undertaking the surgery or if there was lack of facility or lack of maintenance of medical protocols which are necessary to observe before undertaking any eye surgery,” the bench added.
