Hearing a habeas corpus petition filed by a Panchkula woman seeking release of her 19-year- old live-in partner from the custody of the latter’s parents, the Punjab and Haryana High Court has asked the state of Haryana to produce the 19-year-old and her parents before the court on January 4, 2024.
According to the petitioner, who is 22 years old, she and her partner entered into a relationship after meeting some time ago. The petitioner stated that the parents of her partner were against this relationship and tried to persuade their daughter to break all ties with the petitioner. When their daughter refused to do so, they threatened to harm the two and to marry her off forcibly.
The petitioner contended that her partner informed her of her family’s plans to get her married off in June 2023 and asked for help. On this, they both escaped to Delhi. When they came to know about an FIR registered at Panchkula, they returned and appeared before the Sector 25 police station to record their statements regarding their desire to live together. The petitioner alleged a police official present there slapped and abused both of them. Later, they were produced before the magistrate.
However, on leaving the court premises, the police official forced them to get into the police vehicle and took them back to the police station. The petitioner alleged her partner was slapped repeatedly and taken inside the police station where her parents along with other family members were waiting. The petitioner said that after that, she could not contact her partner.
The petitioner made representations to the Haryana DGP and Haryana Women Commission for rescuing her partner, but no action was taken.
