In a first, Odisha court finds juvenile guilty in narcotic drugs case | Bhubaneswar News

A juvenile justice board court in Odisha has convicted one juvenile under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985, in a two-year-old case related to the seizure of contraband brown sugar. This is the first such conviction of a minor in the state in an NDPS case.

The juvenile was found guilty by the court Friday and sent to Special Home, Berhampur for a period of three years for the offence under Section 21 (c) of the NDPS Act, 1985.

Conviction of a juvenile in an NDPS case is also rare in India, said police sources.

The court has directed to provide reformative services including education, skill development, counselling, behaviour modification therapy, psychiatric support, and treatment to the child in conflict with law (CCL) during his period of stay in the Special Home.

This case relates to the seizure of 1.26 kg brown sugar by the special task force (STF), Bhubaneswar from the possession of accused persons on August 12, 2021, said STF sources. The STF is the specialised wing of the Odisha Police formed to curb organised crime.

During the raid, the STF had apprehended three accused persons along with the juvenile near the Khurda bus stand, around 25 km from the state capital, and seized the contraband product and other incriminating articles from their possession.

“After a successful investigation, a chargesheet was submitted against the accused persons U/S 21(c)/29 NDPS Act, 1985. During the course of the investigation, the seized brown sugar was also sent to the State Forensic Science Laboratory (SFSL), Odisha for chemical examination and opinion was received affirmatively,” said an STF official.

During the trial, the prosecution had examined 11 witnesses and examined 44 documents.

“Narcotic drugs are the main focus area of STF and it will continue its drive against such drug peddlers,” said STF IG J N Pankaj.

Since 2020, the STF has seized more than 73 kg of brown sugar/heroin, 202 gram of cocaine, and more than 116 quintals of ganja/marijuana, 750 gram of opium, and arrested more than 183 drug dealers and peddlers. The STF has also destroyed over 62 kg of seized brown sugar in the last one year, Pankaj told the Indian Express.
