Haryana: IPS officer says deployed on ‘non-cadre, non-existing post’ | Chandigarh News

The state government on March 3 this year had posted Kumar as IGP home guards. However, quoting the gradation list of IPS officers and the IPS 2017, (Fixation of Cadre Strength) Amendment Regulation of Haryana, Kumar informed Kaushal that the IGP home guards is not a cadre post in the state. He also added that the home department has informed the Punjab and Haryana High Court in October this year that the post of IGP home guards was never created by the state government.

According to Kumar, even then he has was assigned the post despite there being vacant cadre posts in Haryana in IGP rank to allegedly “insult, humiliate and harass him in public view for over seven months now”.

Seeking an FIR against additional chief secretary (home) TVSN Prasad “for his harassment”, Kumar alleged that the IAS officer and a senior IPS officer (now retired) “had conspired to humiliate him in public view by posting him on a post which was never created and doesn’t exist”.

The IPS officer also pointed out that Prasad in January this year had written a DO letter to the state police chief for adequate representation of IPS officers belonging to the Scheduled Castes at all levels of the public administration in Haryana having public dealing duties. However in March this year, Kumar said, he was posted as IGP home guards, “which doesn’t exist”.

In his complaint, Kumar also noted that during the tenure of Prasad as additional chief secretary (home), the representation of IPS officers belonging to the SCs in field postings in the rank of IGP/ADGP has come down from two to currently one.

“As per IPS Cadre Rules 1954 and IPS (Fixation of Cadre Strength) Amendment Regulation 2017, an IPS officer cannot hold an ex-cadre post in excess to the permissible number– which is 19 for Haryana,” Kumar mentioned in his complaint.

The IPS officer also blamed the additional chief secretary for not taking any action on his representation regarding his arrears and effective date of promotion for the past over one year which is causing financial losses to him.
In fact, sources say, several IPS officers in Haryana have been promoted with effect from “retrospective effect” (from January 1 of the respective year) even if the orders of promotions were issued after passing of some months. But more than them are those IPS officers—including Kumar– who were promoted with immediate effect which means their promotion will be counted from the date when the promotion orders were issued. As the alleged “discrimination” caused a heartburn among a few IPS officers, there have been voices to fix the same as they also want retrospective effect to their promotions.

Prasad was not available for comments but an official privy to the developments told The Indian Express that the matter related to the posting of Kumar on a non-cadre post has been put up before the government for examination. On the issue of allegations against the additional chief secretary, the official claimed that “this was just an administrative matter” adding the postings of IPS officers are made at the level of the Chief Minister.

On the issue raised by Kumar for his arrears, the official said the issue may be put up before the government, adding the home department has been informed that there are 2-3 other senior IPS officers who have already availed such arrears.

The official also said that the home department may send recommendations to the government for corrective action for more representation to the officers belonging to the SCs for their appointment as IGP/ADGP for the public dealing duties.
